Washington State Law of Agency
Today I would like to talk about agency law. In Washington State we have “The Law of Agency”. This law requires that you be provided with a pamphlet explaining the law of agency when a real estate licensee begins providing real estate services. It details the responsibilities of the parties according to state law.
What does this mean? It means agents are legally bound by rules of confidentiality and loyalty and can take no action that is detrimental to you. As a listing agent it means you always represent the seller and can never step out of that role. It also means that the buyers’ agent has those same duties to the buyer.
In my mind it means that dual agency is impossible because I cannot serve two masters. Dual agency demands written consent from both parties for the agent to represent both parties. I strongly encourage those of you who are listening to never approve of your agent practicing dual agency because it is never in your best interest to do so.
